As of August 15, 2026, Wisconsin generally treats hemp-derived delta-9 drinks as lawful hemp when they fit the current federal definition created by the 2018 Farm Bill. That means no more than 0.3% delta-9 THC by dry weight. Qualifying hemp is permitted for retail sale under Wisconsin law, and THC in qualifying hemp is excluded from the state's Schedule I listing. That's the legal path these drinks use.
But lawful hemp isn't the same thing as complete federal food approval. The FDA says food with added THC can't be introduced into interstate commerce. States can and do restrict or ban hemp drinks, local rules can differ, and the rules change. Wisconsin's latest statewide proposals failed. Check current Wisconsin and local rules before you buy.
