Where to buy THC drinks in Virginia

In Virginia, these drinks aren’t limited to dispensaries. Look at registered hemp and CBD shops, smoke shops, grocery and convenience stores, private beer and wine retailers, and some bars or restaurants. Each physical seller needs its own hemp retail registration. Edible hemp sellers also need the applicable food authorization unless an exemption applies. Stock can move fast under the new cap, so call before you go.

Our directory tracks Brez and Ohho at Virginia sellers. It also tracks Hippie Crippler as a brand that ships. Those listings help you narrow the search, but they don’t guarantee today’s inventory or confirm that every package now meets Virginia law. Check the label for total THC per package, then confirm availability with the seller.

Richmond sits at the center of Virginia’s map

Richmond is the first place I’d search in our Virginia data. The city has a local history with THC drinks too. Bingo Beer Co. worked with Virginia grower Pure Shenandoah on canned 2 mg THC cocktails, with placements reported at Bingo, The Camel, and Point Five. Exact inventory there is unknown now, especially after the August rule change.

Outside Richmond, the directory spreads east through Virginia Beach and Norfolk, then through Northern Virginia in Arlington, Alexandria, Manassas, and Fairfax. Roanoke gives western Virginia its own starting point. Why does that matter? A statewide legal rule doesn’t create statewide availability. The useful question is what a registered seller near you actually carries today.

What the August cap means on the shelf

Virginia changed the shelf on August 15, 2026. A retail package can contain no more than 2 mg total THC, and the old 25 to 1 CBD to THC exception is gone. There was no sell through period for older inventory. That means a drink that appeared in a Virginia shop before the change may no longer be legal for that shop to sell.

On this page, THC drinks are packaged beverages containing THC derived from hemp. Virginia counts total THC, including delta-8 and delta-9, instead of looking only at delta-9. So what should you check? Read the package total, not just the serving line. Look for child resistant packaging and a certificate of analysis from an accredited independent lab. Synthetic THC derivatives in ingestible products are prohibited.

Are THC drinks legal in Virginia?

Hemp derived THC drinks exist under the 2018 Farm Bill when they meet the federal standard of under 0.3% delta-9 THC by dry weight. But states can and do restrict or ban them. Virginia does. As of August 15, 2026, a retail package must also stay at or below 0.3% total THC and 2 mg total THC.

That federal dry weight test isn’t enough by itself in Virginia. Sales are limited to people 21 and over through properly registered sellers that meet the applicable food, packaging, labeling, and testing rules. The new cap is being challenged in court, and the latest report available for this guide said the judge was still deliberating. Check current Virginia rules before buying.

Another federal change is scheduled for November 12, 2026. It would exclude finished hemp cannabinoid products above 0.4 mg THC per container from the federal hemp definition, though Congress could still change the timing or text. Virginia’s separate adult use marijuana retail market is scheduled to open July 1, 2027. Rules are moving. And driving after drinking THC is a hard no.

Frequently Asked Questions

Are THC drinks legal in Virginia?
Yes, but only tightly limited hemp derived products remain legal at Virginia retail. As of August 15, 2026, each package must contain no more than 0.3% total THC and 2 mg total THC. The federal under 0.3% delta-9 THC by dry weight standard is not enough on its own in Virginia.
Can I purchase THC drinks in Virginia?
Yes, if you’re 21 and over and the product meets Virginia’s current limits. Buy from a registered seller with the required food authorization or exemption. Because the August cap removed many previously legal packages without a sell through period, check the label and confirm current stock before making a trip.
Are THC seltzers legal in Virginia?
Yes, a THC seltzer can be legal if the whole package stays within Virginia’s 0.3% total THC limit and 2 mg total THC cap, and it meets the state’s packaging, labeling, and testing rules. The old 25 to 1 CBD to THC exception no longer applies.
Can you order THC drinks online in Virginia?
Don’t assume an online listing can legally ship to your Virginia address. The package still has to meet Virginia’s current total THC and package limits, and federal rules are scheduled to change. Check the seller’s Virginia policy, the package label, and current state and local rules before ordering.
How old do you have to be to buy THC drinks in Virginia?
You must be 21 and over to buy a THC containing hemp product in Virginia. That applies even if a website or store presents the drink like an ordinary seltzer. Keep it away from children. Virginia also requires child resistant packaging for edible hemp products that contain THC.
What are Virginia’s hemp laws for THC beverages?
Virginia requires retail packages to contain no more than 0.3% total THC and no more than 2 mg total THC. Sellers need a separate registration for each location, plus applicable food authorization or an exemption. THC edibles also need compliant labels, child resistant packaging, and accredited lab testing. Synthetic THC derivatives in ingestible products are prohibited.
