Are THC drinks legal in Texas?

Texas currently allows registered retail sales of compliant hemp-derived delta-9 drinks. The federal starting point is the 2018 Farm Bill, which created the hemp category. In Texas, a consumable hemp product may contain no more than 0.3% delta-9 THC by dry weight. That dry weight rule is why hemp-derived THC drinks exist in this category at all.

States can restrict or ban these products, and Texas has its own restrictions. Delta-8 and several other synthetic THC forms came under the controlled schedule on July 31, while compliant delta-9 drinks remained available. Buyers must be 21 or older, and sellers must inspect valid government-issued identification. Finished products require cannabinoid testing, and labels must link to a certificate of analysis.

The rules are still moving. DSHS plans more rulemaking, and a federal hemp definition scheduled for November 12, 2026 could remove many current THC drinks from hemp status. FDA also considers interstate commerce in food with added THC prohibited. Check current Texas and local rules before buying or ordering. If you drink THC, don't drive. That's a hard no.
