Are THC drinks legal in South Carolina?
As of August 15, 2026, a nonalcoholic hemp derived delta-9 drink can be lawful in South Carolina when that specific product is under 0.3% delta-9 THC by dry weight. That federal hemp framework comes from the 2018 Farm Bill and appears in South Carolina law. The Attorney General said a drink meeting the statutory threshold is legal under current law. The opinion also says legality must be decided product by product.
That's the current state answer, but it isn't a clean approval of every can on a shelf. South Carolina has no statewide minimum age, hemp beverage retail license, THC amount label rule, testing rule, or packaging rule now in force. The Agriculture Department also says THC added food or drink can't be manufactured in South Carolina and points to the FDA rule against introducing it into interstate commerce. Whatever state law says, this guide is for people 21 and over only.
Then the federal clock matters. A federal definition change is scheduled for November 12, 2026. It would exclude final hemp cannabinoid products with more than 0.4 milligrams of THC per container. A measure passed by the Senate could delay that change, but it had not cleared the House or received a presidential signature as of August 15. Rules can change fast here.
