So what fits on that temporary shelf? Through November 13, 2026, compliant cans may list no more than 10 mg total THC. New Jersey also permits a resealable 750 mL bottle with 40 labeled servings of 5 mg each and no more than 200 mg total THC. A qualifying independent lab certificate of analysis must accompany the sale. That's an unusually specific temporary shelf, not an open hemp market.

New Jersey's shelf also has a genuinely local thread. Kalo is grown and produced at a longtime Morris County farm, bottled locally, and described by News 12 as made entirely in New Jersey. That origin doesn't change the licensing rules. You still need to buy through an eligible channel and confirm the current rule before you go.

Starting November 14, a hemp produced beverage over 0.4 mg total THC per container is treated as cannabis. It must be made by a licensed Class 2 cannabis manufacturer and sold only by a Class 5 cannabis retailer, unless New Jersey changes the law. Pending S4452 and A5338 could create a liquor store path for low dose cannabis drinks, but they weren't enacted when I checked.

Are THC drinks legal in New Jersey?

The 2018 Farm Bill is why hemp derived THC drinks exist at all. It opened a federal lane for hemp under 0.3% delta-9 THC by dry weight. But that test alone isn't enough in New Jersey. That makes New Jersey legal in a narrow sense, not broadly open. The temporary exception matters because New Jersey generally treats a final product with more than 0.4 mg combined total THC per container as outside hemp. The federal dry weight test alone doesn't settle the answer here. Rules are changing, so check current New Jersey and local rules before buying.
