You may still spot those cans in ordinary retail, but current state guidance doesn't make that a lawful sales channel.
So what gets you through tonight's errand without guessing? Start with the seller, not the can. Confirm that the business appears in the CCC's licensed directory, bring ID showing you're 21 or over, and check that the product is a regulated cannabis beverage. If you drink one, driving is a hard no.

Are THC drinks legal in Massachusetts?
Why do hemp THC drinks show up at all? The 2018 Farm Bill is why hemp-derived drinks exist in the first place. It defines hemp as cannabis under 0.3% delta-9 THC by dry weight. States can and do restrict or ban those products, and Massachusetts currently does. State health guidance says hemp-derived THC can't be added to retail food or nonalcoholic beverages.
That means a Farm Bill compliant can isn't automatically legal on a Massachusetts shelf. The ABCC ordered hemp-derived CBD and THC beverages off liquor-licensed premises, including alcoholic and nonalcoholic products. Making the drink outside Massachusetts doesn't avoid the rule. The state says only CCC-regulated retailers may sell beverages with THC as an ingredient.
Rules may change later in 2026. Massachusetts has ordered a hemp-cannabinoid study with recommendations due December 15, while S.2663 remains pending. A separate federal hemp definition change is scheduled for November 12. Neither development makes general-retail hemp drinks legal in Massachusetts today. Check current state and local rules before you buy, and stick to licensed channels if you're 21 or over.
