What Louisiana changed in 2026

Act 392 took effect on August 1, 2026. It added certain licensed locations where consumable hemp is a principal commodity to Louisiana's rules about intentionally permitting people under 18 to visit or loiter. The law includes event exceptions. It didn't lower the purchase age. That remains 21. Louisiana now separates the rules for buyers from the rules governing who may spend time inside certain licensed premises.

The bar and restaurant rules are unusually specific too. A business with a Class A alcohol permit can't receive a new hemp retail permit. Bars and restaurants that held both permits before June 17, 2024 can keep selling under the grandfather rule. A bill that would have changed Class A eligibility was withdrawn in May 2026. So the old cutoff still does real work.

Why Louisiana cans look different

Louisiana doesn't stop at the federal dry weight test. Under the state cap, an approved single serving beverage label can list no more than 5 mg of total THC. The container must hold at least 12 ounces. Every serving needs its own tamper evident container, and a package can hold no more than four containers. So why do the cans and packs look so standardized here? State law leaves little room for another format.

These drinks also can't contain alcohol. A retailer can't pour hemp extract into a cocktail, soda, or other drink at the counter. The legal product has to arrive registered with the Louisiana Department of Health, with the product and label approved. That makes the can itself important. Are THC drinks legal in Louisiana?

Yes. Compliant hemp derived THC drinks can be sold at retail in Louisiana as of August 15, 2026. The 2018 Farm Bill is why hemp-derived drinks exist at all. It uses the threshold of under 0.3% delta-9 THC by dry weight. But states can and do restrict or ban these drinks. Louisiana uses no more than 0.3% total THC by dry weight and adds its own product, permit, and sales rules.

Meeting that federal threshold isn't enough here. Drinks sold in Louisiana must be registered with LDH, and their products and labels must be approved. Sellers need the proper permits and must obtain products through a Louisiana permitted wholesaler. Retail sales, purchases, and possession are limited to people 21 and over. Bring valid photo identification. Driving after drinking THC is a hard no.

That's a Louisiana state law answer, not an unconditional federal food law conclusion. FDA says the Farm Bill preserved its authority over cannabis derived foods. The federal picture may also change soon. A new definition scheduled for November 12, 2026 would exclude final hemp-derived cannabinoid products over 0.4 mg THC per container.
