Are THC drinks legal in Georgia?
As of August 15, 2026, Georgia expressly permits hemp derived delta-9 drinks that meet its consumable hemp rules. The opening comes from the 2018 Farm Bill, which made room federally for hemp under 0.3% delta-9 THC by dry weight. Georgia still applies its own tighter product rules, and states can and do restrict or ban these drinks. So legal here does not mean unregulated.
For a Georgia can, the legal concentration limit is the lesser of 0.3% total delta-9 THC or the federal limit. A compliant label can list no more than 10 mg total delta-9 THC per 12 fluid ounces, and the container cannot exceed 12 fluid ounces. Products also face testing, labeling, tamper evident packaging, and child resistant packaging rules. The seller needs a Georgia retail consumable hemp license.
There's also a federal problem sitting outside Georgia law. The FDA says interstate sale of food with added THC is not legal. A new federal definition scheduled for November 12, 2026 would exclude finished cannabinoid products with more than 0.4 mg combined total THC per container. A proposed delay was not law when I checked on August 15. Rules change, so check current federal, Georgia, and local rules before you buy.
Where to buy THC drinks in Georgia
Where should you look when the liquor store is ruled out? Start with a retailer holding a current Georgia consumable hemp license. The permitted channels include hemp and CBD specialty shops, licensed groceries and health food stores, convenience stores, gas stations, nonalcoholic bottle shops, and some restaurants and bars. The statewide details for poured service versus sealed cans aren't clear, so ask the venue how it sells them.

These drinks are only for adults 21 and over. Driving after a THC drink is a hard no.
