Are THC drinks legal in Washington DC?
Based on the District rules I could verify on August 15, 2026, Farm Bill compliant hemp delta-9 drinks aren't lawful general retail merchandise in Washington DC. The 2018 Farm Bill created a federal path for hemp products under 0.3% delta-9 THC by dry weight. States and DC can restrict or ban those products, and District rules are stricter.
So what can be sold lawfully? Medical cannabis beverages can move through the District's licensed medical cannabis system. Under standard DC medical ingestible rules, a labeled serving can contain no more than 20 mg THC and a labeled package no more than 200 mg. The rules also list higher exceptions.
At the July 2 Council hearing, ABCA said cannabis beverages were legal in the medical program but weren't yet available through the licensed market. The agency expected the first products soon. By August 15, I still couldn't verify packaged shelf inventory from a live licensed menu. That's fine, but it means event listings and old directories need a fresh check.
A pending DC bill would let endorsed alcohol manufacturers produce alcohol free medical cannabis beverages for licensed cannabis manufacturers.
