Are THC drinks legal in California?
As of August 15, 2026, hemp-derived delta-9 THC drinks with any detectable total THC can't be lawfully sold in California. The state's permanent rules require no detectable THC in each serving of a final-form hemp beverage. Federal compliance doesn't create a California retail exception. Cannabis-derived drinks remain legal through the licensed cannabis system.
The 2018 Farm Bill is why hemp-derived drinks sold under 0.3% delta-9 THC by dry weight exist at all. But states can and do restrict or ban them, and California has. The rules keep changing, so check current local rules before you buy. THC drinks are for people 21 and over. Driving after drinking THC is a hard no.
Where to buy THC drinks in California
So where can you actually buy one? In California, the lawful route is a licensed cannabis dispensary or licensed delivery operator selling cannabis-derived drinks. Mainstream liquor stores, grocery stores, smoke shops, bars, and online hemp merchants can't lawfully sell hemp drinks with detectable THC. Check the retailer's California cannabis license before you order.

Some California cities also authorize cannabis consumption lounges. Those lounges can allow cannabis use on site, and some advertise cannabis cocktails with tableside delivery. How California's THC drink shelf got this way
California drew a hard line between hemp and cannabis. Since January 1, 2026, AB 8 has required hemp extract used in beverages to be CBD or CBN isolate above 99% purity, with no THC or synthetic cannabinoids. That leaves intoxicating drinks in the licensed cannabis channel instead of the ordinary retail shelf.
You may still see a hemp drink on a shelf or a website willing to ship. That doesn't make the sale lawful. California alcohol regulators were still visiting licensed locations and seizing illegal products in 2026. A broader hemp pathway into the cannabis system is set for 2028, but the details still depend on state rules. It doesn't legalize retail hemp THC drinks today.
